At the time of the rejection, the examiner has no information about Ali's interaction with Ming. In the reply to the Office action, Acme's attorney files a declaration under 37 CFR 1.130(a) signed by Ali to show that Ming's disclosure of X is not prior art because Ming learned about X from Ali.
